In an era where every click, swipe, and share leave a digital footprint, the sanctity of personal privacy is more critical than ever. Enshrined in Article 31 of the Constitution of Kenya, this right to privacy is the bedrock upon which our digital lives stand. Yet, recent events have thrust this right into the spotlight as the Office of the Data Protection Commissioner in Kenya wields its authority to impose significant fines on individuals and institutions who have breached the provisions of the Data Protection Act. Just recently, consider the case of the educational institution in Uthiru, Nairobi and entertainment establishment along Ngong Road, Nairobi – both facing substantial penalties for violations of the Data Protection Act.
